Building Permits
Through an inter-local agreement with Mecklenburg County, all building permit activity in the Town of Mint Hill and the extra-territorial jurisdiction is provided by Mecklenburg County Land Use and Environmental Services Agency (LUESA). LUESA has a variety of resources to help homeowners and contractors alike.
Homeowners can refer to the Homeowner's Tool Box for a helpful overview of building permitting, including details of When a Building Permit is Needed and the Homeowners Internet Permit Process.
Homeowners should also take advantage of the Residential Technical Assistance Center (RTAC). Town staff can assist you with setbacks and other zoning requirements, but for detailed building code issues the County is the point of contact.

The Definition Of Deck, Found In Section 2.4 Of The Mint Hill Unified Development Ordinance (Udo) Is "A Structure Without A Roof, Either Freestanding Or Attached To A Building, Which Is Supported By Posts Or Pillars."
What If My Proposed Deck Encroaches Into The Setback?
In Section 6.1.7 Of The Udo, There Are Certain Items That Are Allowed To Project Into The Required Setbacks, Including Decks. Any Deck Not More Than 6 Feet Above The Finished Grade Level Shall Not Project More Than 25% Into Any Required Setback.

A Deck Enclosure Would Include Roofing And Screening The Sides Of An Area On A Deck To Protect That Area From Outside Wind And Rain.

You must fill out an application with the Mecklenburg County Health Department (MCHD) and follow the permit procedures outlined by Mecklenburg County. Call (704) 336-5101 for more information.
